Does Spain’s Digital Nomad Visa Require a Police Clearance?

Adult applicants are generally required to provide criminal-record documentation as part of Spain’s telework or Digital Nomad Visa process. Official Spanish consular guidance shows that the certificate may need to cover countries where the applicant has lived during a specified period before the application.

The exact lookback period and how recently the certificate must have been issued can differ between consular offices, so South African applicants should confirm the current Pretoria or BLS checklist before relying on a certificate they already have.

Which South African Police Clearance Do You Need?

For South African applicants, the relevant document is the official Police Clearance Certificate issued by the South African Police Service (SAPS) Criminal Record and Crime Scene Management division.

A locally issued character reference, affidavit, private background check or ordinary police-station letter is not the same as a SAPS Police Clearance Certificate.

Does a South African Police Clearance Need an Apostille for Spain?

For Spanish visa and residence applications, foreign public documents commonly need to be legalised or apostilled where applicable. Official Spanish guidance specifically requires criminal-record documents to be apostilled or legalised in many visa categories.

Because South Africa is a party to the Hague Apostille Convention, an eligible original South African Police Clearance Certificate can generally follow the Apostille route when the receiving Spanish authority requires it.

Does the Police Clearance Need to Be Translated into Spanish?

Spanish consular guidance commonly requires foreign documents that are not in Spanish to be accompanied by an official or sworn Spanish translation.

The translation requirement is separate from the Apostille. In practice, applicants should confirm whether the receiving office wants the Police Clearance, the Apostille, or both translated and whether a sworn translator recognised for the application is required.

How Recent Must the Police Clearance Be?

This is one of the most important details to check before applying.

Spanish consular offices do not always publish exactly the same recency rule. Some official Digital Nomad Visa instructions refer to criminal-record certificates issued within a defined number of months and may also require records covering residence during the previous two or five years.

For DIRCO legalisation in South Africa, a SAPS Police Clearance Certificate submitted for Apostille or Authentication must be recent enough to meet DIRCO’s legalisation requirements. Do not order the certificate too early without checking your visa timeline. Equally, do not leave it until the last moment, because fingerprint submission, SAPS processing, Apostille and courier delivery can all affect timing.

What If You Lived in More Than One Country?

If you have lived in another country during the period specified by the Spanish consular office, you may also need a criminal-record certificate from that country.

Each certificate can have its own legalisation and translation requirements. The fact that you have a South African Police Clearance does not automatically replace a certificate required from another country where you have lived.

Can You Use an Older South African Police Clearance?

Possibly, but only if it still meets both the Spanish authority’s recency requirement and any legalisation requirement that applies.

If the certificate is too old for DIRCO legalisation, or older than the period accepted by the Spanish office receiving the visa application, you may need to obtain a new one.

Before starting again, ask the visa centre or consular office to confirm the maximum acceptable age of the certificate.
