What Is a DIRCO Apostille?
If you need to use a South African document overseas, you may be asked to have the document apostilled or authenticated.
However, not every South African document follows the same legalisation process. Some official public documents can be submitted to the Department of International Relations and Cooperation (DIRCO), while other documents may first need verification or may need to follow the Notary Public and High Court route.
DIRCO’s Legalisation Section legalises certain South African official public documents for use outside South Africa.
If the destination country is a party to the Hague Apostille Convention, the document may be issued with an Apostille Certificate.
If the destination country is not a party to the Hague Apostille Convention, a Certificate of Authentication may be required instead.
The destination country is therefore important because it determines which legalisation process applies.
Which Documents Can Be Submitted to DIRCO?
Depending on the document and whether all required signatures and stamps are in place, several types of South African public documents can be legalised through DIRCO.
South African Birth Certificates
Original birth certificates issued by the Department of Home Affairs can generally be submitted to DIRCO for legalisation, provided they meet DIRCO’s requirements.
For many international applications, an unabridged or full birth certificate is required.
Birth certificates may be needed for immigration, foreign citizenship applications, overseas residency, family reunification, marriage abroad or registering a child overseas.

South African Marriage Certificates
Qualifying original marriage certificates issued by the Department of Home Affairs can also be legalised.

Marriage certificates are commonly required for foreign residency, citizenship, spousal visas and other international administrative processes.

SAPS Police Clearance Certificates
South African Police Clearance Certificates issued by SAPS can be submitted to DIRCO for legalisation.
DIRCO’s current guidance states that an original Police Clearance Certificate submitted for legalisation should not be older than six months.
Police Clearance Certificates are commonly required for immigration, residency applications, overseas employment, citizenship applications, work permits and visa applications.

Letter of No Impediment
A South African Letter of No Impediment confirms a person’s marital status and is frequently requested when a South African intends to marry overseas.
For DIRCO legalisation, the document must meet the required Department of Home Affairs signature and stamp requirements.
For legalisation purposes, the Letter of No Impediment must meet DIRCO’s current requirements and applicable validity period.

Driver’s Licence Confirmation Documents
A physical South African driver’s licence itself cannot simply be submitted to DIRCO for an Apostille.
The appropriate confirmation or verification documentation must first be obtained through the relevant Department of Transport process.

Educational documents may require an additional verification step before DIRCO legalisation.

Which Documents Do Not Go Directly to DIRCO?
Some private or notarised documents may need to follow a different legalisation process.

Other private documents
Depending on the document and destination country, the process may involve a Notary Public and the relevant High Court instead of DIRCO.
A High Court Apostille should not normally be submitted to DIRCO for another Apostille.
DIRCO Apostille vs High Court Apostille
The correct authority depends mainly on the type of document.
Official South African public documents such as qualifying Home Affairs certificates and SAPS Police Clearance Certificates generally follow the DIRCO route when the requirements are met.
Certain private or notarised documents may instead follow the Notary Public and High Court route.

An Apostille and a Certificate of Authentication are not the same thing.
Generally:
Hague Apostille Convention country = Apostille
Non-Hague country = Authentication process
