South African Apostille for Birth, Marriage and Police Clearance Documents
If you need to use a South African Birth Certificate, Marriage Certificate or Police Clearance Certificate overseas, the receiving authority may require the document to be apostilled.
However, not every version of these documents can simply be sent for an apostille.
DIRCO has specific requirements regarding original documents, signatures, stamps, document age and the type of certificate being submitted.
Understanding these requirements before starting can prevent unnecessary delays or rejected documents.
What Is an Apostille?
An Apostille Certificate is used to confirm the origin of an official public document for use in another country where the Hague Apostille Convention applies.
It verifies the relevant official signature and seal on the document.
An apostille does not change the information contained in your certificate and does not correct errors in the document.
The document itself must already meet the legalisation requirements before it can be apostilled.
Which South African Documents Can Be Apostilled Through DIRCO?
Certain original South African public documents can be submitted directly to the Department of International Relations and Cooperation Legalisation Section.
These include eligible original:
• Birth certificates
• Marriage certificates
• Death certificates
• Letters of No Impediment
• Police Clearance Certificates
• Citizenship documents
• Driver’s Licence Confirmation Letters
The document must be issued, signed and stamped by the appropriate South African authority.

Apostille for a South African Birth Certificate
An original Birth Certificate issued by the Department of Home Affairs may be submitted to DIRCO for legalisation if it contains the required official signature and stamp.
Depending on your application, the foreign authority may require:
• An Unabridged Birth Certificate
• A Full Birth Certificate
• Another specific Home Affairs-issued version
The authority receiving the document should tell you exactly which certificate they require.
Do not assume that every type of Birth Certificate will be accepted for your particular overseas application.
Can an Abridged Birth Certificate Be Apostilled?
DIRCO distinguishes between valid original public documents and shortened computer printouts that do not contain an authorised signature and stamp.
A certificate that does not contain the required official signature and stamp may not be accepted for legalisation.
For international applications, an Unabridged or Full Birth Certificate is often the safer document where fuller birth information is required.
Always confirm the exact certificate requirement with the receiving authority.
Apostille for a South African Marriage Certificate
Marriage certificates require particular care.
The marriage certificate originally issued by the marriage officer at the wedding is not accepted by DIRCO for legalisation purposes.
If your South African marriage certificate needs to be legalised, DIRCO requires the appropriate original Home Affairs-issued Marriage Certificate.
For many overseas applications, this means obtaining an Unabridged Marriage Certificate from the Department of Home Affairs first.
Why Can’t the Marriage Officer’s Certificate Be Used?
The certificate issued by the marriage officer is not the same as the Home Affairs-issued document required for DIRCO legalisation.
If you only have the certificate from your wedding ceremony or marriage officer, you may first need to obtain the correct certificate from Home Affairs.
This is an important distinction because submitting the wrong version can delay an immigration, citizenship or foreign marriage-registration application.
What About a Vault Marriage Certificate?
A Vault Marriage Certificate is a certified copy of the original marriage register and is different from an Unabridged Marriage Certificate.
Some foreign authorities specifically request a vault copy.
If the authority requesting your documents uses wording such as:
• Vault copy
• Certified copy of the marriage register
• Original marriage register
confirm exactly what they need before arranging legalisation.
Apostille for a South African Police Clearance Certificate
An original South African Police Clearance Certificate issued by the SAPS Criminal Record and Crime Scene Management division can be submitted to DIRCO for legalisation.
DIRCO requires the Police Clearance Certificate to be:
• Original
• Issued by SAPS
• Signed and stamped correctly
• No older than six months
A Police Clearance Certificate is treated as valid for legalisation purposes for six months from its date of issue.
Why the Six-Month Rule Matters
If your Police Clearance Certificate is older than six months, you may need to obtain a new one before DIRCO will legalise it.
This is especially important if you obtained the Police Clearance early in an immigration or visa process and only later discovered that it also required an apostille.
Foreign authorities may also impose their own document-age rules.
Always check both DIRCO requirements and the requirements of the organisation receiving the document.
Can a Copy of a Police Clearance Certificate Be Apostilled?
DIRCO does not legalise a certified copy of a Police Clearance Certificate in place of the required original public document.
If the receiving authority requires the apostilled original Police Clearance Certificate, make sure the original document is used for the correct process.
Different procedures may apply to notarised copies, but these are not automatically equivalent to legalising the original document.
Can Certified Copies of Birth or Marriage Certificates Be Apostilled?
Certified copies of public documents do not automatically follow the same process as original Home Affairs certificates.
DIRCO specifically requires eligible original public documents for direct legalisation.
A notarised copy may follow a High Court route in certain circumstances, but this authenticates the notarial process rather than turning the copy into the original Home Affairs public document.
If the overseas authority asks for an apostilled original, the safest approach is to obtain the correct original document first.
How Old Can Birth and Marriage Certificates Be?
DIRCO advises that older original documents may create problems if the signature of the official who originally signed the document is no longer available in its signature database.
For this reason, DIRCO advises that documents submitted for legalisation should preferably not be older than three years.
The country receiving your document may impose an even shorter age requirement.
Always check before using an older certificate.
What If My Document Is Laminated?
DIRCO does not accept laminated documents for legalisation.
If your certificate has been laminated, you may need to obtain a new original document before starting the apostille process.
This is another reason to avoid laminating original Home Affairs or SAPS documents that may later need to be legalised internationally.
Apostille or Authentication?
The destination country determines which form of legalisation is required.
If the Hague Apostille Convention applies between South Africa and the destination country, an Apostille Certificate will generally be used.
If the Convention does not apply, DIRCO may instead issue a Certificate of Authentication.
Further embassy or consular legalisation may then be required depending on the destination country.
What Information Does DIRCO Need?
The country where the document will be used must be provided.
DIRCO needs this information to determine whether the document requires:
• An Apostille Certificate, or
• A Certificate of Authentication
This is why you should know the destination country before beginning the legalisation process.
How Long Does Apostille Processing Take?
